Já não é lugar incomum tratar da relação entre direito e economia nos meios acadêmicos. Mas essa mesma constatação já não pode ser feita quando o assunto é tratar da relação entre direito e economia na sociedade moderna, caracterizada justamente pelo seu alto nível de contingência e complexidade. Esse tipo particular de observação implica que se vá além de um trabalho de aproximação e coloca um desafio de, ao mesmo tempo, explicar e (tentar) normatizar uma relação situada numa realidade complexa demais para ser reduzida às categorias próprias de cada subsistema social - ainda que haja uma união entre categorias. O trabalho de união entre economia, direito e sociedade importa, portanto, uma observação desencantada com abordagens caracterizadas ou pelo seu excessivo otimismo ou pelo seu excessivo pessimismo sobre as possibilidades e limitações de junção entre direito e economia. É nesse sentido que se utiliza da Teoria dos Sistemas de Niklas Luhmann nessa investigação interdisciplinar.
