Rechtsprechung und Schrifttum postulieren mittlerweile aufgrund verschiedener europäischer Richtlinien und deren Umsetzung mehrheitlich, dass die Frage eines Arbeitgebers nach dem Vorliegen von Schwerbehindertenstatus oder Gleichstellung bei einem Bewerber nicht länger und bei einem Arbeitnehmer nur mit Einschränkungen zulässig ist. Der Arbeitgeber ist damit gehindert, eine für ihn möglicherweise bedeutsame Information jederzeit zu erlangen, Bewerber bzw. Arbeitnehmer wiederum müssen nur unter bestimmten Voraussetzungen informieren. Diese Thematik der asymmetrischen Informationslage wird sowohl aus juristischer, als auch unter ökonomischer Perspektive u.a. mit Hilfe der ökonomischen Analyse des Rechts betrachtet und eine Folgenabschätzung bezüglich der bestehenden Rechtslage abgeleitet.
