Das Verzögerungsverbot im Strafverfahren
Die angemessene Dauer des Strafverfahrens beschäftigt sowohl die Rechtsprechung als auch das strafrechtliche Schrifttum. In diesem Zusammenhang auftretende Fragestellungen werden überwiegend unter dem Topos des sog. Beschleunigungsgebots diskutiert. Dabei geht es aber nicht nur um Fragen der gebotenen Kompensation von überlangen Strafverfahren, sondern auch um die Auslegung und Fortbildung des Strafverfahrensrechts im Lichte des Beschleunigungsgebots.Robert Pest legt dar, dass es sich beim Beschleunigungsgebot in Strafsachen im Grunde um ein Verbot vermeidbarer, staatlicher Verfahrensverzögerungen handelt, also kurz gesagt, um ein Verzögerungsverbot im Strafverfahren. Ausgehend von dieser Prämisse werden Berechtigung und Grenzen des sog.
