This book takes a close look at the Court of Arbitration for Sport (CAS), challenging existing claims and answering previously unanswered questions, by considering all of its publicly available decisions, both in its entirety as a body of jurisprudence and on a case-by-case level. It also investigates the actors involved in adjudication before the CAS, both the parties that bring disputes before the CAS and the arbitrators that resolve them, and in so doing establish precedents that govern sports generally. While the book relies upon and includes more traditional legal theory and analysis, it combines this with an empirical analysis of a large portion of the CAS's decisions. Hereby it relies upon and relates to the theory of the development of a transnational legal order in sports, the lex sportiva. The publication is targeted at and will benefit those professionally working in or interested in the fields of sports law, arbitration law, transnational law, or empirical legal studies. During the recent decades Conversation Analysis has developed into a distinctive method for analyzing talk in interaction. The method is utilized in several disciplines sharing an interest in social interaction, like anthropology, linguistics, social psychology, and sociology, and it has been applied to a great variety of languages and types of interaction. Conversation Analysis then is coming of age as a truly comparative enterprise. This volume presents and discusses comparative approaches to analyzing interactional practices and structures. The contributors to the volume have their background in sociology, linguistics, and logopedics. They offer comparative analyses of activity types, participant roles and identities, displays of emotion, and design of actions such as questions and corrections. Establishing individual criminal responsibility for mass atrocities is the foundational principle of international criminal justice, but this process is highly complex, and is accompanied by political and legal dilemmas about its operation. The book examines the drafting, interpretation, and application of the rules for assessing individual criminal responsibility as those rules emerge from the intense contestations among judges, lawyers, and academics within the legal field.
