Acquisition and Loss of Ownership of Goods
This volume contains the major result of the work undertaken by the international research group "Transfer of Movables" which belonged to the Study Group on a European Civil Code. It covers the most important aspects of the law of property in movables, such as the transfer of ownership based on the transferor's right and the good faith acquisition of ownership. The suggested black letter provisions are accompanied by extensive explanatory comments and comparative notes providing information on the existing rules of the EU Member States. As compared to Book VIII of the DCFR, this volume contains additional and partly revised national notes, extended comments, translations of the black letter rules and adapted registers. The "Principles of European Law" are published in co-operation with Oxford University Press and Staempfli (Switzerland).

Un contratto di larga diffusione, qual è l’estimatorio, trova nel volume un’organica trattazione, che si sofferma sugli aspetti problematici di particolare interesse pratico, fornendone una soluzione basata su una ponderata ricostruzione sistematica del dato normativo. La cui pietra angolare è rappresentata dalla innovativa descrizione della posizione dell’accipiens rispetto ai beni, nei termini di “proprietà limitata”, perché caratterizzata da una facoltà di disposizione piena e da una facoltà di godimento, per così dire, “compressa”, e tuttavia capace di “riespandersi” nel momento in cui la cosa sia trasferita al terzo o sia fatta dall’accipiens definitivamente propria per il fatto di non essersi avvalso della facoltà di restituire entro lo scadere del termine all’uopo fissato. La quale consente di dare una razionale soluzione al, sino ad ora irrisolto, rebus degli artt. 1556-1558 c.c.
