Esta obra explora a interação entre os direitos fundamentais de propriedade e de moradia, analisando como esses direitos podem entrar em rota de colisão, mesmo sendo garantidos pela Constituição e por documentos internacionais de direitos humanos. Com o aumento das demandas judiciais, algumas questões são levadas ao Supremo Tribunal Federal (STF) para resolução. Diante disso, o estudo centra-se na aplicação da teoria da proporcionalidade, que permite o sopesamento entre os direitos em conflito, atribuindo maior peso a um deles de maneira justificada. O objetivo principal é investigar como o STF utiliza essa teoria para harmonizar os direitos de propriedade e de moradia. A pesquisa também inclui a definição e positivação dos direitos fundamentais, com capítulos dedicados à análise da construção dos direitos de propriedade e de moradia. Por meio da análise de decisões do STF, observa-se que, em certos casos, o direito à moradia é priorizado em relação ao direito de propriedade, levando em conta as particularidades de cada situação.

Focusing on the period between the beginning of the eighteenth century and the late twentieth century, this edited volume examines the histories of objects, museums, exhibitions, and collections in Portugal or outside Portugal but representing Portugal, or related to it through colonial relationships. The book highlights the specificities of the Portuguese case, set against a globalised, transnational, and transcolonial context, and provides a precedent for future studies and a dialogue with equivalent studies related to other geographies. The diversity of the cultural, intellectual, and political contexts (imperial, colonial, monarchical, republican, authoritarian) offered by the Portuguese example allows for the exploration of a number of complex case-studies. Chapters study the artistic, collecting, and museological practices in Portugal and in the various geographical contexts of its colonial empire, with particular emphasis on the circulation and connectedness of objects, products, people, and ideas. This volume, The Brazilian Studies in the Philosophy and History of Science, is the first attempt to present to a general audience, works from Brazil on this subject. This book compares the respective concepts of the law of nations put forward by the Spanish theologian Francisco Suárez and by the Dutch jurist Hugo Grotius. This comparison is based on the fact that both thinkers developed quite similar notions and were the first to depart from the Roman conception, which persisted throughout the entire Middle Ages and the early Renaissance. In Rome, jus gentium was a law that applied to foreigners within the Empire, and one which was often mistaken for Natural Law itself.
