In welchem Umfang und warum verbieten verschiedene Rechtsordnungen den Einsatz von insolvenzbezogenen Losungsklauseln? Welche Regelungskonzepte gibt es? Patrick Keinert beschaftigt sich mit diesen Fragen und sucht nach der bestmoglichen Losung im Umgang mit Beendigungsrechten in der Insolvenz. Hierzu untersucht und vergleicht er die Rechtslage in Deutschland, in der Schweiz, in Osterreich, in Frankreich, in den Vereinigten Staaten und in England. Anhand weiterer Rechtsordnungen zeichnet er den internationalen Trend nach. Aus dem Rechtsvergleich erarbeitet er einen konkreten Gestaltungsvorschlag und anschliessend einen Gesetzesvorschlag. Dabei spricht sich der Autor fur ein grundsatzliches Verbot von insolvenzbezogenen Losungsrechten aus. In Anlehnung an die osterreichische Losung sieht der Gestaltungsvorschlag fallgruppenabhangig die Nichtigkeit oder eine Ausubungssperre der Losungsklauseln vor.
