Legal Accents, Legal Borrowing

  • Categories: Law

A wide variety of problem-solving courts have been developed in the United States over the past two decades and are now being adopted in countries around the world. These innovative courts--including drug courts, community courts, domestic violence courts, and mental health courts--do not simply adjudicate offenders. Rather, they attempt to solve the problems underlying such criminal behaviors as petty theft, prostitution, and drug offenses. Legal Accents, Legal Borrowing is a study of the international problem-solving court movement and the first comparative analysis of the development of these courts in the United States and the other countries where the movement is most advanced: England,...

Examining the treatment of persons with mental disabilities in the criminal justice system, this book offers new perspectives that are crucial to an understanding of the ways in which society projects onto criminal defendants prejudices and attitudes about responsibility, free will, autonomy, choice, public safety, and the meaning and purpose of punishment, all with a focus on ways to enhance dignity in the criminal trial process. It is a detailed exploration of issues of adequacy of counsel; the impact of international human rights law, following the ratification of the United Nations Convention on the Rights of Persons with Disabilities (CRPD); the role of mental health courts; and the inf...

Legal Perspectives on State Power

  • Categories: Law

The issue of consent and criminal law commonly focuses on consent in sports, sexual activity, and medical treatment. The notion of consent and the influence of state control in this context, however, are pervasive throughout the criminal justice process from the pre-trial stage to rehabilitation. This edited collection charts an important and original pathway to understanding these important issues, pre-, during, and post-trial, from a range of perspectives, including doctrinal, socio-legal, intersectional, medico-legal, feminist, critical legal, and queer theoretical viewpoints. The collection addresses the complex inter-relationship between consent and state control in relation to private ...

In response to recognition in the late 1960s and early 1970s that traditional incarceration was not working, alternatives to standard prison settings were sought and developed. One of those alternatives -- community-based corrections -- had been conceived in the 1950s as a system that might prove more progressive, humane, and effective, particularly with people who had committed less serious criminal offenses and for whom incarceration, with constant exposure to serious offenders and career criminals, might prove more damaging than rehabilitative. The alternative of community corrections has evolved to become a substantial part of the criminal justice and correctional system, spurred in rece...

This book examines Mental Health Courts (MHC) within a socio-legal framework. Placing these courts within broader trends in criminal justice, especially problem-solving courts, the author draws from two case studies with a mixed-methods design. While court observational and interview data highlight the role of rituals and procedural justice in the practices of the court, quantitative data demonstrates the impact of incentives, mental health treatment compliance and graduating patterns from MHC in altering patterns of criminal recidivism. In utilising these methods, this book provides a new understanding of the social processes by which MHCs operate, while narrative stories from MHC participants illustrate both the potential and limitations of these courts. Concluding by charting potential improvements for the functioning and effectiveness of MHCs, the author suggests potential reforms and ‘best practices’ for the future in tandem with rigorous analysis. This book will be of value and interest to students and scholars of criminology, law, and social work, as well as practitioners.
