A novel look at the role of the advocate in (UK) law. The authors suggest that, contrary to the orthodox view that law is about close analysis of text, law is more to do with persuasion, rhetoric, and negotiation. They conclude with an extended restatement of the neglected Realist views of Jerome Frank. Distributed by Taylor and Francis. Annotation copyrighted by Book News, Inc., Portland, OR

As paper recedes into the background and digital data becomes the primary resource in the information society, what does this mean for privacy? Can there be privacy when every communication made through ever-developing ubiquitous devices is recorded? What factors should underpin the creation of new means of regulation? The papers in this collection have been drawn together to develop the positive and negative affects upon the information society which privacy regulation implies.

The Computerised Lawyer

The aim of the Applications of Advanced Computing Techniques Series is to publish accounts of particular computer application areas which provide good examples of advanced practice in the fields concerned. In some volumes, the techniques described will be advanced because of the particular computer technologies used. In other volumes the techniques will be advanced because they illustrate new ways of using computing in particular fields, or because they raise new social and ethical issues. All the volumes are designed to be readable both for practitioners working in the application area concerned (in this case lawyers) and for computer professionals interested in leading edge applications. Philip Leith meets all these objectives in this volume. The first four chapters provide a valuable introduction to computer concepts and methods of holding information, from the specific point of view of the practising lawyer or student. Whilst some of these issues may be familiar to computer practitioners it is only through a proper appreciation of the technology that the real benefits to the working lawyer become clear.

Software and Patents in Europe

  • Categories: Law

The computer program exclusion from Article 52 of the European Patent Convention (EPC) proved impossible to uphold as industry moved over to digital technology, and the Boards of Appeal of the European Patent Organisation (EPO) felt emboldened to circumvent the EPC in Vicom by creating the legal fiction of 'technical effect'. This 'engineer's solution' emphasised that protection should be available for a device, a situation which has led to software and business methods being protected throughout Europe when the form of application, rather than the substance, is acceptable. Since the Article 52 exclusion has effectively vanished, this text examines what makes examination of software invention difficult and what leads to such energetic opposition to protecting inventive activity in the software field. Leith advocates a more programming-centric approach, which recognises that software examination requires different strategies from that of other technical fields.

Cosgrove (history, U. of Arizona) traces the gradual divorce of legal theory from legal history since the 18th century, and argues that in the 20th century it has become more narrow and elitist the more theorists strive to make it relevant to legal practice. The solution, he says, is for jurisprudence to return to its interdisciplinary roots and draw from the insights of economics, politics, and sociology. Around the world, legal information managers, law librarians and other legal information specialists work in many settings: law schools, private law firms, courts, government, and public law libraries of various types. They are characterized by their expertise in working with legal information in its many forms, and by their work supporting legal professionals, scholars, or students training to become lawyers. In an ever-shrinking world and a time of unprecedented technological change, the work of legal information managers is challenging and exciting, calling on specialized knowledge and skills, regardless of where in the world they practice their profession. Their role within legal systems...
