A atividade notarial e de registro assume grande relevância na condução dos serviços extrajudiciais em auxílio dos que são prestados pelos órgãos jurisdicionais. Os serviços desenvolvidos pelos Notários e Registradores estão presentes na declaração e constituição de direitos, assim como na publicidade, autenticidade, segurança e eficácia dos atos e negócios jurídicos celebrados nos chamados Cartórios, denominação que ainda não foi abandonada pelos profissionais do Direito e pela população. A responsabilidade civil dos Notários e Registradores é controversa, quanto a sua subjetividade ou objetividade, assim como a responsabilidade civil do Estado, o qual predomina, na jurisprudência, a responsabilidade civil subsidiária deste.
