Tort law is one of the core areas of European private law, in particular in the field of business law. However, it often receives less attention than the well-known and widely published developments in the field of European contract law. In order to direct more attention to this important subject, an intensive Round Table discussion on the subject of the evolution of torts in European business law was held. Aus juristischer Sicht ist Rechtsmissbrauch eine lastige Randfigur, die ausnahmsweise eine Korrektur des Rechts im Einzelfall ermoglicht. Distanziert man sich vom binaren Rechtscode, so wird ein viel tiefer liegendes Problem sichtbar: Rechtsmissbrauch ist der Wiedereintritt (re-entry) der Unterscheidung Recht/Unrecht in sich selbst. Das Rechtssystem kann das Paradoxieproblem nur um den Preis negativer Selbstreferenz losen, und dies fuhrt auf Antinomien im System zuruck. Fallstudien zum Zivilrecht, Europarecht und Kartellrecht zeigen, dass die Figur des Rechtsmissbrauchs eine Rolle spielt, wenn sich Berechtigte widerspruchlich verhalten. Darunter fallen inkonsistente Selbstdarstellungen ebenso wie das gleichzeitige Nutzen und Unterlaufen von Moglichkeitsbedingungen.
