Dynamic of Ethnic Relations in Southeast Asia

Dr Mahathir Mohamad, former Prime Minister of Malaysia, said in the Far Eastern Economic Review, 28 October 1996: “The threat is from inside ... So we have to be armed, so to speak. Not with guns, but with the necessary laws to make sure the country remains stable.” He implied that ethnic conflict and political instability are inevitable in a multi-ethnic society unless protected by certain laws. Ethnic conflict is like a time bomb. The misuse of human rights for political ends and to exploit ethnic sentiments can spark ethnic conflict. In theory, the modern nation-state must achieve pluralism in its project of nation building. There are few nations in the world which consist of a single...

Legal Protection of Intangible Cultural Heritage

  • Categories: Law

The book examines whether the protection of Intangible Cultural Heritage (ICH) by Indonesia and Malaysia upheld the interests of the various communities from which the cultural heritage originates, and whether the laws recognise that cultural heritage is often shared with other states and communities. The legal classifications of various indigenous communities and the interpretations of ‘indigeneity’ in the two countries have presented problems in the context of ICH protection. The state is regarded as holding the intellectual property rights for some forms of ICH and this also posed problems in the implementation of the laws to protect the communities’ ICH. This book employs a community-based perspective and adopts a multidisciplinary approach in exploring questions of the rights to and benefits of heritage. This book will be useful for students, academics and policy makers with an interest in international law, heritage and intellectual property rights.

Region, Nation and Homeland

Movements tell stories of oppression and liberation. They critique the power relations that exist. They offer alternative visions of the homeland they hope to build. This volume looks at the Moro and Cordillera movements as told in their own words. Within and among these movement organizations in the Philippines, their constructed identities and claims for demanding the right to self-determination differed and evolved over time. The author shows the significant intertextuality in the discourse of the Moro Islamic Liberation Front, which broke away from the Moro National Liberation Front. She traces the drift to heightened ethnonationalism in the case of the Cordillera Peoples’ Liberation Army when it split from the national democratic Cordillera People’s Democratic Front. She reflects on where these mobilizations are now, and the strands of discourses that have remained salient in current times.

Whither Southeast Asia Terrorism?

More than 11 years after the 9/11 attacks and 10 years after the October 2002 Bali bombings, the need for a comprehensive assessment of what the countries in Southeast Asia have achieved is overdue. We need to consider whether the strategies against both the domestic and transnational terrorist and extremist threat have been appropriate and have yielded desired results. The aim of this book is to make a comprehensive assessment of the threats of terrorism and extremism in the region and of the policies and practices adopted by the regional countries to counter the same. It is also necessary to evaluate if the region has become a safer place after the decade-long fight. Most importantly, it i...
