Judaism in Motion

In Israel, where the Orthodox rabbinate wields historically sanctioned influence over the legal definitions of marriage and parenthood, same-sex parenthood raises important questions such as what constitutes belonging to the national collective, who has the authority to define the norms of reproduction, and where the boundaries of Orthodox Judaism begin and end. Judaism in Motion addresses these questions from a transgenerational perspective that pays heed to how religiously informed rules, norms, and practices of transferring material properties, names, and societal belonging are adopted and transformed. It presents a detailed ethnographic account of the dynamic interaction between kinship, religion, and the state that complicates the commonly held assumption that places same-sex parenthood in a radically secular sphere that stands in stark opposition to Orthodox Judaism. Taking same-sex parenthood as a prism through which society at large is reflected, this volume further explores how transformations of societal structures take place, and what flexibility and leeway exist in organized religions.

This volume on medical tourism includes contributions by anthropologists and historians on a variety of health-seeking modes of travel and leisure. It brings together analyses of recent trends of "medical tourism", such as underinsured middle-class Americans traveling to India for surgery, pious Middle Eastern couples seeking assisted reproduction outside their borders, or consumers of the exotic in search of alternative healing, with analyses of the centuries-old Euro-American tradition of traveling to spas. Rather than seeing these two forms of medical travel as being disparate, the book demonstrates that, as noted in the introduction ‘what makes patients itinerant in both the old and ne...

Quasi Person

This book delves into the controversial subject of late-term abortions, particularly those occurring after 24 weeks of gestation. It emphasizes that the abortion debate is multifaceted, involving ethical, legal, medical, and philosophical aspects. Different countries have diverse policies on abortion, from strict prohibitions to more permissive approaches. Recent legal developments in the United States, exemplified by the Dobbs v. Jackson Women's Health Organization case overturning Roe v. Wade, have stirred significant legal, political, and public upheaval surrounding abortion rights. Advancements in medical technology have enabled early detection of fetal defects, forcing expectant mothers...

Reproductive Technologies as Global Form

In the thirty-five years since the first +test-tube baby,[&½] in-vitro fertilization and other methods of reproductive assistance have become a common aspect of family life and medicine in affluent nations and, increasingly, throughout the world. How do persons seeking treatment, donors, and medical experts make use of these reproductive technologies? How in crossing borders between nations do they manage to evade legal and bioethical regulations? And how do they make sense of these new modes of making kinship against the backdrop of diverse world-views and social settings? --

Islam and Assisted Reproductive Technologies

How and to what extent have Islamic legal scholars and Middle Eastern lawmakers, as well as Middle Eastern Muslim physicians and patients, grappled with the complex bioethical, legal, and social issues that are raised in the process of attempting to conceive life in the face of infertility? This path-breaking volume explores the influence of Islamic attitudes on Assisted Reproductive Technologies (ARTs) and reveals the variations in both the Islamic jurisprudence and the cultural responses to ARTs.

Kinship, law and religion

This monograph examines the Iranian and Shia legal debates on technologies of assisted reproduction (including embryo donation and surrogacy) and looks at the regulations and implementation of these technologies in Iran. In particular, it addresses: 1) an analysis of the moral reasoning embedded in the Shia theological legal discourse on reproductive technology and how this tradition interprets assisted reproduction with a particular focus on underlying concepts, structure and principles of kinship; 2) the emergence and development of the relevant legislation, regulations and administrative policies and how this might shape the relationship between civil and religious law in Iran, and 3) the ways in which reproductive technology is used and understood with particular focus on underlying values, local narratives and the resulting societal dynamics. The methodological approach for this research is a combination of extensive ethnography and textual analysis of important academic and religious seminary publications in Iran, from Shia jurisprudence (fiqh) and Persian histories to the analysis of laws and verdicts.

Divine Money

Zakat giving or mutual aid is a sacred practice in Islam. Where government and public safety nets fail, zakat serves as a form of social security in Muslim communities. In Divine Money, Emanuel Schaeublin shows how zakat institutions and direct zakat donations function in contemporary Palestine. Based on his ethnographic fieldwork in the city of Nablus, Schaeublin traces zakat flows as they provide critical support to households living under military rule and security surveillance. In the neighborhoods of Nablus, the Islamic tradition shapes public life. Many enact simple gifts of money of food as an expression of God's generosity and justice. How do such invocations of the divine enable people to negotiate responsibilities and tensions arising from differences in wealth in Palestinian society? What is the role of zakat in confronting political repression and economic instability?
