The book tries to identify the main contours of unjusticiability and non-justiciability from an historical and comparative perspective distinguishing between common law world and civil law tradition. In the light of a general overview, the aim of this publication is to reflect on the utility of paving the way for a much wider approach to unjusticiability. More precisely, some scholars have recently suggested that such a notion could embrace all the situations where a court does not decide a case, so that it is impossible for the plaintiff to have the case decided by a court. A first category covers the situations where the court refuses to judge because it does not want to judge. A second category is related to all the cases where there is an impossibility to reach a decision. Any case where the judge cannot or does not wish to make justice--si iudex non facit iustitiam--continues to indicate a series of new (and old) questions.

Our oceans need a strong and effective environmental rule of law to protect them against increased pressures and demands, including climate change, pollution, fisheries, shipping and more. The environmental rule of law for oceans requires the existence of a set of rules and policies at multiple governance levels that appropriately regulate human activities at sea and ensure that pressures on the marine ecosystem are tackled effectively. Die vorliegende Untersuchung befasst sich mit den allgegenwärtigen Fragen, welches rechtliche Schicksal der menschliche Körper nach dem Tod nimmt, ob der Leichnam vererbt wird und wer in welchem Umfang über ihn bestimmen darf. Die Autorin gelangt zu dem Ergebnis, dass das Totenfürsorgerecht als wesentlicher Bestandteil des - im Grundgesetz als Staatszielbestimmung zu verankernden - sog. postmortalen Persönlichkeitsschutzes auf die Wahrung der Pietät ziele und zuvörderst dem Willen des Verstorbenen verpflichtet sei. Bei unbekanntem Verstorbenenwillen dürfe der Totenfürsorgeberechtigte aber in einigen wenigen Bereichen auch eigene Entscheidungen über den ihm anvertrauten Leichnam treffen. Der Umgang mit dem Leichnam lasse sich bislang keinem bekannten Rechtsinstitut zuordnen und stelle Gewohnheitsrecht dar. Gegenwärtig herrsche Rechtsunsicherheit. Zur Behebung des gesetzgeberischen Defizits schlägt die Autorin ein Bundesgesetz vor und unterbreitet hierfür einen Gesetzesvorschlag.
