Public Preferences and Institutional Designs

  • Categories: Law

This book explores the existence of gaps between public preferences and institutional designs in democracies, and specifically cases in which such gaps are maintained for a long period of time without being challenged by the electorate. Gaps such as these can be seen in the complex relations between the state and religion in Israel and Turkey, and more specifically in their policies on marriage. This line of investigation is interesting both theoretically and empirically, as despite their poles apart policies, Israel and Turkey share a similar pattern of institutional dynamics. Existing explanations for this phenomenon suggested either civil society-based arguments or intra-institutional dynamics, as reasons for the maintenance of such gaps. This book enriches our understanding of policy dynamics in democratic systems by introducing a third line of argument, one that emphasizes the effective role state institutions play in maintaining such arrangements for long periods, often against the public will.

China and the Internet

Two oversimplified narratives have long dominated news reports and academic studies of China’s Internet: one lauding its potentials to boost commerce, the other bemoaning state control and measures against the forces of political transformations. This bifurcation obscures the complexity of the dynamic forces operating on the Chinese Internet and the diversity of Internet-related phenomena. China and the Internet analyzes how Chinese activists, NGOs, and government offices have used the Internet to fight rural malnutrition, the digital divide, the COVID-19 pandemic, and other urgent problems affecting millions of people. It presents five theoretically informed case studies of how new media ...

Rome Convention - Rome I Regulation

  • Categories: Law

As of 17 December 2010, the Rome I Regulation (EU Regulation 593/2008) on the law applicable to contractual obligations is directly applicable in all EU Member States with the exception of Denmark. The Rome I Regulation replaces the Rome Convention of 1980 in the EU Member States and will apply to all contracts concluded as of 17 December 2010. However, and herein lies the utility and great importance of this work, the Rome Convention and the Rome I Regulation will be applied in parallel for a significant time to come (the author himself anticipates a ten-to-fifteen year period); in the latter case to contracts made after 17 December, 2010. This is why this commentary takes into account both...

A Confucian Analysis on the Evolution of Chinese Patent Law System

  • Categories: Law

This book comprehensively discusses the main features of the Chinese patent law system, which not only legally ‘transplants’ international treaties into the Chinese context, but also maintains China’s legal culture and promotes domestic economic growth. This is the basis for encouraging creativity and improving patent law protection in China. The book approaches the evolution of the Chinese patent system through the ancient Chinese philosopher Confucius’s classic principle, offering readers a fresh new way to understand and analyze Chinese patent law reforms, while also outlining how Confucian insights could be used to improve the enforcement of patent law and overall intellectual pr...
