Das Assistenzkonzept zur Gewährleistung des Selbstbestimmungsrechts von Kindern im Rahmen der Heilbehandlung
Die rechtliche Beurteilung der Heilbehandlung von minderjährigen Patienten ist mit Unsicherheiten verbunden. Die obergerichtliche Rechtsprechung muss als uneinheitlich bezeichnet werden. Eine Entscheidung des Bundesgerichtshofs ist nicht in Sicht. Dieses Buch fokussiert auf das medizinische Selbstbestimmungsrecht von Kindern. Es liefert Gründe für ein Alleinentscheidungsrecht einwilligungsfähiger Minderjähriger. Zugleich zeigt es Wege auf, wie auch schon sehr junge Kinder mithilfe eines Assistenzkonzepts als Subjekte in die Planung und Gestaltung ihrer Behandlung eingebunden werden können.
