O crime de recebimento indevido de vantagem abrange as situações em que o particular oferece, promete ou concede ao funcionário uma vantagem para o exercício da função, sendo punível com prisão até três anos ou multa. A lei penal portuguesa inspirou-se diretamente na lei alemã. O que merece ser destacado nesta norma incriminadora é o facto de não se exigir que a vantagem se destine à gratificação de ações ou omissões concretas por parte do funcionário, bastando que haja uma conexão genérica com o exercício da função. Ora, a aplicação desta norma incriminadora pelos tribunais alemães não tem sido isenta de dificuldades. Nada melhor do que analisar então os casos da jurisprudência alemã, a fim de antecipar as dificuldades no tocante à aplicação deste recente tipo de crime da lei portuguesa.
