Este libro reconstruye el proceso de transición entre el Antiguo Régimen penal y la codificación –con sus paulatinas reformas legales inspiradas en las ideas iluministas y liberales–, a partir de una lectura crítica de la producción historiográfica existente. Se divide en cuatro partes: Ideas jurídicas, Derecho castellano-indiano, Derecho patrio y Derecho codificado, más un apéndice. La parte que aborda el Derecho codificado gira en torno de tres ejes: los caracteres generales, la criminalidad y el proceso codificador, capítulo a su vez subdividido en los antecedentes, el código de 1886 y el de 1921, los nuevos proyectos, las reformas y la legislación complementaria del segundo código.
