A presente obra representa a maturação do pensamento e o esforço empreendido pelo autor, com o escopo de se analisar o processo de formação e desenvolvimento do Estado sob um enfoque histórico evolutivo. Como responsável por disciplinar as relações sociais, atribuíram-lhe competências e prerrogativas ante o cidadão, para que detivesse poder de império, sobrepairando – na maioria das vezes – o interesse coletivo em detrimento do individual. Contudo, para se evitar ou corrigir o cometimento de arbitrariedades desenvolveram-se diversos mecanismos, entre os quais se encontra o controle de constitucionalidade de leis e atos normativos do poder público. Neste livro, analisaram-se o seu surgimento, o seu desenvolvimento, as suas modalidades e as diversas consequências que ensejam. Por fim, demonstrou-se como e por que o Estado deve ser responsabilizado civilmente pela edição de leis ou atos normativos inconstitucionais, visto a frustração da legítima expectativa de seus cidadãos em não ter os seus direitos violados, justamente por quem foi criado para – em ultima ratio – defendê-los.
