O Direito das Contra-Ordenações é um ramo do Direito recente que integra o Direito Público punitivo ou sancionatório e que conhece desde finais dos anos 80 do século passado uma expansão sem par e uma configuração distinta da anterior, herdada das antigas contravenções. Não há hoje sector da actividade social onde o Direito das Contra-Ordenações não tenha penetrado e são frequentes as alterações promovidas pelo legislador a este respeito (de que constitui exemplo recente a entrada em vigor do Regime Jurídico das Contra-Ordenações Económicas). Este desenvolvimento trouxe consigo novos problemas, de natureza substantiva e processual, alguns deles com relevância constitucional, que têm inquietado os sectores da comunidade jurídica que lidam mais de perto com a matéria contra-ordenacional.
