Os direitos dos trabalhadores e, principalmente, a questão do tempo de trabalho e da limitação da jornada de trabalho estiveram desde cedo no cerne das reivindicações dos trabalhadores. A legislação foi evoluindo até que, no caso de Portugal, chegamos às oito horas por dia e quarenta horas por semana (art. 203o, no1 CT). As NTIC e o desenvolvimento tecnológico que trouxeram consigo os smartphones, tablets e computadores, permitem que os trabalhadores prestem a sua atividade ou recebam contactos dos seus empregadores fora do seu local de trabalho. Esta facilidade na prestação da atividade laboral acarreta mais horas de trabalho, sobretudo não remunerado, visto que é muitas vezes realizado, informalmente, fora do horário de trabalho. É neste contexto de permanente conexão dos trabalhadores, que traz consigo eventuais violações aos direitos fundamentais dos mesmos, nomeadamente ao repouso e lazeres, limite de jornada de trabalho e descanso semanal (art. 59o, n,o1, al. d) CRP), que surge a necessidade de se criar um direito que permita que os trabalhadores se desliguem efetivamente do trabalho.
