Contoh dari peradilan yang gagal adalah Peradilan Athena (Yunani Kuno) ketika mencarikan keadilan untuk Sokrates, sang filsuf, peradilan Israel Kuno ketika memutus kasus Yesus dari Nazaret, dan pada tahun 2017 peradilan Indonesia yang memutus kasus mantan gubernur DKI Jakarta Basuki Tjahaja Purnama alias Ahok (BTP). Ketiga peradilan itu adalah peradilan sesat, karena keliru mempertimbangkan dan menerapkan aturan hukum, sehingga merugikan yang diadili, dan bahkan menghukum yang tidak bersalah. Kasus BTP, Yesus, dan Sokrates menggugah nurani dan menimbulkan pertanyaan: pengadilan seperti apa yang dianggap mandiri? Adalah suatu kenyataan yang tidak dapat dipungkiri bahwa para terdakwa dalam ketiga kasus ini telah diadili dengan dakwaan yang dibuat-buat, dan proses pengadilan mereka dibayang-bayangi oleh konflik politik.
