English Lawyers Between Market and State

  • Categories: Law

During the 1990s, reforms in the English legal profession transformed traditions, over the vigorous objections of the judiciary, Bar, and Law Society. This book mines that tumultuous period for insights into the prospects of professionalism in the 21st century.

This book explores the problems associated with regulating the funding of political parties and election campaigns in a timely assessment of a topic of great political controversy. From interest in Obama's capacity to raise vast sums of money, to scandals that have rocked UK and Australian governments, party funding is a global issue, reflected in this text with case studies from Australia, Canada, New Zealand, United Kingdom, and the United States. Taking an interdisciplinary approach with leading scholars from politics, geography and law, this text addresses key themes: contributions, spending controls, the role of broadcasters and special interests, and the role of the state in funding po...

Propriety and Honours

The Committee is conducting an inquiry into issues of propriety, transparency and accountability in the honours system in light of recent allegations that honours have been offered in return for loans to party funds and sponsorship of the Government's city academy schools and that loans have been made to political parties to avoid disclosure under the Political Parties, Elections and Referendums Act 2000. This report follows on from previous Committee reports on the subject published in July 2004 (HCP 212-I, session 2003-04, ISBN 0215018370) and March 2006 (HCP 1020, session 2005-06, ISBN 0215028252). This report sets out the Committee's provisional findings, notwithstanding a Metropolitan P...

QUESTION: How many lawyers does it take to finish the roof of a two-thousand-square-foot house with dormers? ANSWER: Depends on how thin you slice them. Lawyers, and, more to the point, lawyer stories, have been sliced, diced, and presented for consumption for centuries. Ever since Dick the Butcher suggested in Shakespeare's Henry VI Part 2 that "the first thing we do, let's kill all the lawyers," the profession has exhibited a strong appeal for readers...to say nothing of an enduring image problem. Today, stories about life on the front lines of the nation's courtrooms fuel everything from the novels of John Grisham and Scott Turow to television shows like The Practice, Ally McBeal, and L.A...

Joint enterprise

  • Categories: Law

Joint enterprise is a form of secondary liability whereby a person who agrees to commit a crime with another becomes liable for all criminal acts committed by the other person (the principal offender) in the course of their joint criminal venture. It is a common law doctrine, which means it has been developed by the courts over the years. Inthis report the Justice Committee find that the law on joint enterprise is so confusing for juries and courts alike that legislation is needed urgently to ensure justice for both victims and defendants and end the high number of cases reaching the Court of Appeal. The MPs also call on the Director of Public Prosecutions to produce guidance for prosecutors on joint enterprise, particularly in cases of gang-related homicide. The Director of Public Prosecutions should collate data on the number of people charged under joint enterprise so that problems with the operation of the law identified by campaigning groups representing both victims and those that say they have been convicted in a miscarriage of justice can be alleviated, if necessary.

Acute, questioning, humane and passionately concerned for justice, Helena Kennedy is one of the most powerful voices in legal circles in Britain today. Here she roundly challenges the record of modern governments over the fundamental values of equality, fairness and respect for human dignity. She argues that in the last twenty years we have seen a steady erosion of civil liberties, culminating today in extraordinary legislation, which undermines long established freedoms. Are these moves a crude political response to demands for law and order? Or is the relationship between citizens and the state being covertly reframed and redefined?
