Deutsches und polnisches Strafrecht sind sich in vieler Hinsicht ahnlich, beispielhaft erkennbar ist dies daran, dass die Strafrechtswissenschaft in beiden Landern dieselben Systembegriffe verwendet. Unterschiede gibt es gleichwohl, so hinsichtlich positiver wie negativer Generalpravention in der Strafzumessung im Allgemeinen und bezuglich der Abschreckungspravention im Speziellen. In Deutschland unter strengen Voraussetzungen bei der Begrundung der Strafhohe zugelassen, ist die Abschreckungspravention in Polen schlechthin verboten. Die Dissertation erlautert Hintergrunde und Anwendungsfelder der Generalpravention und arbeitet anhand der Rechtsprechung verschiedene Fallgruppen heraus.
From Old Times to New Europe
From Old Times to New Europe considers the post-totalitarian legal framework in today's Europe, arguing that the study of totalitarianism and post-totalitarianism continues to be significant as ever. Drawing mainly on the Polish experience, this analysis focuses on the significant part played by history in the development of the region's identity and preferences concerning the role of the state in public and private life. It examines the political, socio-economic and legal aspects of key events and draws comparisons with other CEE states, whilst implementing key socio-legal theories to explain trends and strains in this post-Communist and post-totalitarian period. Regulations Regarding Living Organ Donation in Europe
Organ transplantation is a much-discussed subject, and the importance of living organ donation is increasing significantly. Yet despite all efforts, too few donor organs are available to help all patients in need. This book analyses whether the national legal regulations are also partly responsible for the organ shortage in the Member States of the European Union. In addition to a detailed analysis of the various national regulations, the main arguments in favour of and against legal restrictions on living organ donation are considered. Furthermore, the European Union’s authority is investigated, namely, whether it is entitled to establish statutory provisions for the Member States with respect to a harmonized regulation of living organ donation. Based on the results of the analysis, the author establishes a Best Practice Proposal for living organ donation.
