Os avanços das tecnologias voltadas à coleta e tratamento de dados têm gerado problemas jurídicos no âmbito da privacidade, intimidade, identidade e autodeterminação da pessoa humana, uma vez que, cada vez mais, é necessário a disponibilização de dados por seu titular, de forma consciente ou inconsciente, para que se tenha acesso a determinados produtos e/ou serviços na realização de atividades da vida cotidiana, como, p.ex., o uso de transporte por aplicativo, pedido de comida por delivery, acesso a edifícios comerciais ou residenciais, compras em supermercados etc. Diante dessa incontestável realidade, surge o direito à proteção de dados, como forma de tutela da pessoa humana que tem seus dados utilizados por entes públicos e privados, assim como as diferentes manifestações da personalidade que eles representam. Desta forma, a presente obra busca demonstrar, por meio de instrumentos de direito comparado e da análise de situações fáticas, a importância do reconhecimento do direito à proteção de dados como novo direito da personalidade do século XXI, bem como a exploração de mecanismos aptos a promoverem a proteção integral desse direito.
