The Un Convention on the Rights of Persons with Disabilities

The UN Convention on the Rights of Persons with Disabilities builds on existing human rights treaties including the International Covenant on Civil and Political Rights and the International Covenant on Economic Social and Cultural Rights. The UN Handbook for Parliamentarians on the Convention stresses that it is not intended to create new rights, but "clarifies the obligations and legal duties of States to respect and ensure the equal enjoyment of all human rights by all persons with disabilities". Its purpose is to: "Promote, protect and ensure the full enjoyment of all human rights and fundamental freedoms by all persons with disabilities, and to promote respect for their inherent dignity...

Disability and Equality Law in Britain

  • Categories: Law

The concept of reasonable adjustment (alternatively known as reasonable accommodation) is rapidly gaining significance for countries throughout Europe and beyond. Directive 2000/78 required all EU Member States to ensure that, by the end of 2006 at the latest, reasonable accommodation obligations would operate to protect disabled people from unequal treatment in the context of employment. The new United Nations Convention on the Rights of Persons with Disabilities will require ratifying States to impose such obligations in a broad range of situations. This book provides a detailed and critical analysis of the current and potential role of reasonable adjustment duties in British law. It explo...

Implementation of the Right of Disabled People to Independent Living

This report discusses the implementation of the right of disabled people to independent living in the context of the UN Convention on the Rights of Persons with Disabilities (UNCRPD) which was ratified by the UK in 2009. Delivering Equality for Disabled People

The Disability Discrimination Bill (Cm. 6058-I/II/III, ISBN 010160582X published in December 2003) extends the Disability Discrimination Act 1995 to cover the functions of public bodies, imposing a positive duty to eliminate discrimination and harassment and to promote equality of opportunity for disabled people. This consultation paper seeks views on proposals for the guidance the Disability Rights Commission should issue to support the implementation of these changes, and on the possible use of regulatory powers. Issues discussed include: changing working cultures, the specific duties and range of public bodies covered, guidance to be issued to smaller bodies, content of guidance relating to procurement, how public authorities can promote equality in practice, gathering evidence and reporting progress, implementation of new duties, and costs and benefits of the proposals. Responses to the consultation should be received by 21 October 2004 and sent to: Sue Hammond, Disability Discrimination Bill Division, 6th floor, The Adelphi, London WC2N 6HT or emailed to: Consultation-disability@dwp.gsi.gov.uk

Disability Discrimination Act 1995

  • Categories: Law

This revised Code of Practice deals with the duties established under Part III of the Disability Discrimination Act 1995, and is based on the principle that disabled people should not be discriminated against in their rights of access by those providing goods, facilities or services to the public and those selling, letting or managing premises. It has been written and produced by the Disability Rights Commission; it is a revision of the consultative draft published in May 2000 in order to take account of the further duties under the Act which will come into force in October 2004. These duties relate to the reasonable adjustments to premises required to enable disabled people to use the services available. The Code of Practice is being issued now in order to encourage service providers to be proactive and to assist them in preparing for their extended duties. The Code of Practice is also available in other formats: audio cassette (ISBN 0117029297); braille (ISBN 0117029289); PDF/RTF disk (ISBN 0117029750); Word disk (ISBN 0117029300), and Welsh language hardcopy (ISBN 0117029270)
