Dieses Lehrbuch beleuchtet die internationalen Bezüge des bislang überwiegend national geprägten Strafrechts. Es verfolgt in erster Linie didaktische Ziele. Dem Modell eines modernen deutschen Lehrbuchs folgend schlägt sich dies in einer klaren Sprache, in der Veranschaulichung durch zahlreiche Beispiele und schließlich durch Rückgriff auf viele Übersichten und Grafiken nieder. Durch die Verwendung der englischen Sprache eignet es sich als Lehr- und Lernmittel europa- und weltweit. Darüber hinaus erfüllt es auch im deutschen Sprachraum insoweit einen wichtigen Zweck, als auch hierzulande zunehmend Vorlesungen und Kurse mit internationalem Bezug in englischer Sprache abgehalten werden, so dass zukünftig auch insoweit ein passgenaues Lehrbuch zur Verfügung steht.

Die Frage, welche Strafe einen Täter für seine Tat trifft, fällt unter den Mitgliedstaaten der EU höchst unterschiedlich aus. Zum Abbau daraus folgender Hindernisse für eine justizielle Zusammenarbeit in Strafsachen ist die Angleichung der Rechtsfolgen von Straftaten zusehends in den Fokus der EU geraten. Ein überzeugendes System konnte sich bislang aber nicht herausbilden. Für die internationale Wissenschaftlergruppe European Criminal Policy Initiative war dies Anlass, sich auf die Suche nach einem rechtspolitisch verträglichen Modell zur Harmonisierung strafrechtlicher Sanktionen in der EU zu begeben, das nationale und europäische Interessen bestmöglich ausgleicht. Auf der Basis eines umfassenden Rechtsvergleichs und einer Analyse des existenten Unionsrechts wurde ein Kategorienmodell entwickelt, das dem Gedanken relativer Vergleichbarkeit der Sanktionen entspringt. Der vorliegende Band erläutert dieses neue Modell und sein Entwicklungspotential in englischer und deutscher Sprache.

In an important 2005 judgment, the German Federal Constitutional Court declared void the German Act that was meant to implement the European Union Framework Decision on the European Arrest Warrant. However, according to the Constitutional Court, the Framework Decision itself did not necessarily provoke a breach of the German Constitution. If the German legislator had made adequate use of the tolerance provided by the Framework Decision, he could have avoided any conflict with the Constitution. While, at first sight, the Court's criticism solely seems to refer to German national law, a closer look at some statements that deal with European law reveals a high potential for future disagreement between the German Constitutional Court and European institutions: they do not share the same view as to the development of European cooperation in criminal matters.
