Este livro defende um conceito de objetividade que integre o fenômeno jurídico em sua existência empírica como um elemento conceitualmente necessário, mas não suficiente. O conceito de objetividade inclui necessariamente a existência empírica do direito positivo, mas não só isso. O mero fato de o direito existir como norma jurídica, positivamente estabelecida e socialmente eficaz, já lhe confere certa objetividade. Mas a questão aqui é saber em que sentido se pode falar da objetividade do direito do ponto de vista normativo, ou seja, da norma jurídica enquanto dever-ser. É isto que justifica a importância deste trabalho: analisar e explicitar o conceito de objetividade em teorias jusnaturalistas, positivistas e não-positivistas do direito.
