Legal Position of Churches and Church Autonomy
This book includes all papers presented at the colloquium on Church and State on 28 February and 1-2 March 2001. The colloquium, focusing on the legal position of churches, the autonomy of churches in modern societies and recent tendencies in jurisprudence, was organised by the Faculty of Canon Law of the Catholic University Leuven in collaboration with the Faculty of Theology of the University of Stellenbosch. Both the conference and the book have two objectives. The fist is informing about the South African history on Church and State relationships and its current situation under the new Constitution. The second objective is to search for models leading to a new equilibrium between Church and State in South Africa. Models offered by other countries are examined as a point of reference or as a possible source of inspiration. International scholars and academics, church Ministers as well as leading politicians offer their viewpoints and enter into debate with each other.
Unlocking the Future
This book discusses from various angels the position of women in the Roman Catholic Church more specifically with regard to the diaconate. Theological, historical, pastoral, canonical and legal considerations are taken into account. The book makes clear that the old discussion is also lively today as only the ordination of women to the priesthood is currently closed for further debate. The thoughts developed in this book are certainly not exhaustive, nor do they all go into the same direction. The idea of freedom of religion was developed in Europe in the 16th and 17th century in the context of religious diversity as an alternative for religious wars. The concept requires reconsideration in the current globalized culture: religious plurality has increased as has the awareness of the religious potential for social cohesion and for sectarian division and violence. In this volume, legal experts, sociologists, theologians, and philosophers clarify the historical development of the concept, and analyze the present situation in various countries with religious tensions. They propose possible models and solutions, and discuss the fundamental question of whether the Western model of human rights with its separation of religion and state and freedom of religion can be conceived as universal.

The global world debates secularism, freedom of belief, faith-based norms, the state's arbitration of religious conflicts, and the place of the sacred in the public sphere. This book is devoted to the study of the interplay between religious rules and State law. It explores how State recognition of religious rules can affect the degree of legal diversity that is available to citizens and why such recognition sometime results in more individual and collective freedom and sometime in a threat to equality of citizens before the law.
