A presente obra tem por objeto a investigação dos contornos éticos impostos pelas regras de conduta processual luso-brasileiras, a partir da análise, em ambos os sistemas, dos mecanismos utilizados para a inibição da litigância de má-fé, do excesso de linguagem e do descumprimento de determinações judiciais Seu objetivo é formular propostas para o aprimoramento dos dois ordenamentos, vocacionadas a harmonizar a eficiência estatal com o caráter dialético do processo e com os naturais anseios humanos de liberdade e de desenvolvimento individual.
A Prova Ilícita - Verdade ou Lealdade?
Há Justiça com provas ilicitamente obtidas? A afirmação sublinha o triunfo da Verdade, independente dos meios. A negação, assente na Lealdade e no processo equitativo, proscreve meios de prova desleais. Como salienta António Henriques Gaspar no prefácio: "(...) o sentido de utilidade e a finalidade da prova não podem significar a aceitação de todos os meios e de todas as provas (...). Hoje, no tempo dos relativismos, na pressão das descontinuidades axiológicas e da prevalência de soluções utilitaristas de eficácia imediata e simples, acompanhadas da sedução fácil da intensidade dos meios, do desdém pelos segredos socialmente relevantes e dos pragmatismos avulsos com fragilidade ou ausência de critérios, podemos pressentir um ambiente disposto a afrouxar os limites, envolvido no manto admirado da realização, apenas por aí, da suposta verdadeira justiça". É na busca de solução práctica para os problemas que a prova ilícita convoca, que se efectua a presente reflexão.

This book features a discussion on the modernisation of law and legal change, focusing on the key concepts of innovation" and "transition". These concepts both appear to be relevant and poorly defined in contemporary legal science. A critical reflection on the heuristic value of these categories seems appropriate, particularly considering their dyadic value. While innovation is increasingly appearing in the present day as being the category in which one looks at the modernisation of law, the concept of transition also seems to be the privileged place of occurrence for such dynamics. This group of Italian and Brazilian scholars contributing to this volume intends to investigate such problems through an interdisciplinary prism. Natural Law and Public Reason
"Public reason" is one of the central concepts in modern liberal political theory.
