The Power of Separation

  • Categories: Law

Jessica Korn challenges the notion that the eighteenth-century principles underlying the American separation of powers system are incompatible with the demands of twentieth-century governance. She demostrates the continuing relevance of these principles by questioning the dominant scholarship on the legislative veto. As a short-cut through constitutional procedure invented in the 1930s and invalidated by the Supreme Court's Chadha decision in 1983, the legislative veto has long been presumed to have been a powerful mechanism of congressional oversight. Korn's analysis, however, shows that commentators have exaggerated the legislative veto's significance as a result of their incorrect assumpt...

American Democracy in Crisis

Public disenchantment with and distrust of American government is at an all-time high and who can blame them? In the face of widespread challenges—everything from record levels of personal and national debt and the sky high cost of education, to gun violence, racial discrimination, an immigration crisis, overpriced pharmaceuticals, and much more—the government seems paralyzed and unable to act, the most recent example being Covid-19. It’s the deadliest pandemic in over a century. In addition to an unimaginable sick and death toll, it has left more than thirty million Americans unemployed. Despite this, Washington let the first round of supplemental unemployment benefits run out and for...

Based on events, organizations, and locations that Barbara Goldscheider experienced while working on army bases throughout Israel, Al-Naqba, The Catastrophe follows the parallel stories of an elite Palestinian Arab and an officer of the Israeli Defense Forces. Asa Ibrahimi’s infatuation with the daughter of a desert sheikh is brutally ended when he’s arrested and beaten in the Russian Compound, two of his brothers are killed by Israeli soldiers, and his parents’ home in Ramallah is demolished. Israeli Colonel Neyri Ben-Ner attempts to begin a new life far from the instability of his country by going to Harvard and marrying an American woman. But a return to Israel brings him back to the horror of suicide bombings and mass murders. Both face a personal and political transformation with ramifications beyond their own lives. This epic novel blends drama, suspense, and romance, in the process tallying the tragedies to both parties in this seemingly unstoppable conflict.

What does a middle class nation do without a middle class? An abundance of evidence suggests that we here in the United States are about to find out. Americas Shrinking Middle Class documents trends that have been building not just since the Great Recession, but for over four decades. In 1970, the share of U.S. income that went to the middle class was 62 percent. By 2010 that figure had fallen to 45 percent. In that same year, the median income for middle class Americans had gone from $72,956 to $69,487 a decline of nearly 5 percent in just one year. A shrinking middle class would mean a shrinking economy and an America dominated by a growing lower class. Life would be less comfortable, less prosperous, and less secure. With less money coming in to government and businesses alike, tax burdens would become onerous. One example: Obamacare. It could cost the average taxpayer nearly $6,000 in extra taxes and create a total of 20 new taxes or tax hikes. For a weakened and shrinking middle class, it could be a fatal blow.

The American Vice Presidency Reconsidered

Since 1960 the office of the vice presidency of the United States has evolved into a fundamentally different institution than the one the founders envisioned, attracting better-qualified aspirants who may be called upon to perform a variety of important tasks. This book offers a corrective to the overwhelmingly negative view that Americans have had of their vice presidents by demonstrating how the role has changed over time. In addition, Baumgartner examines those who were candidates for vice president but who were not elected. The book is organized thematically according to the career path of the vice president, from the selection process through campaign and nomination to election, service...
