Violence in the Domestic Sphere
Domestic violence is discussed from perspectives of human rights and legislation, with special focus on international law. The topics include domestic violence and the definition of torture, legal situation and cultural legacy in Afghanistan, female genital mutilation, housing issues and evictions or house bans, the positions of children and domestic homicide.
Divorce in Transnational Families
This book uniquely focuses on the role of family law in transnational marriages. The author demonstrates how family law is of critical importance in understanding transnational family life. Based on extensive field research in Morocco, Egypt and the Netherlands, the book examines how, during marriage and divorce, transnational families deal with the interactions of two different legal systems. Sportel studies the interactions of European and Islamic family law, addressing its interconnections with migration and everyday life, within the context of highly politicised debates on gender, Islam, migration and the family. Beyond Being Koelies and Kantráki
This book traces the self-positioning of Hindostani people in the face of British and Dutch colonial practices. Originally from India and shipped to the Dutch colony of Suriname after the abolition of slavery, the Hindostani served as contract labourers to keep the plantation system afloat from 1873. Central to the book is the perspective of the Hindostani themselves. We travel alongside the Hindostani from the moment they were recruited and their movement through the depots awaiting shipment, their travel experiences, their arrival in Suriname, relocation to plantations, and their dispersal following the end of their contracts, either as city workers, or farmers. All along, the book poses the question of identification: how did Hindostani make sense of themselves, their fellow Hindostani, and Surinamese society? Stereotyped images make way for insight in lived experience of lower and higher caste, Hindus and Muslims, men and women.
The United Nations Convention on the Rights of the Child
In 2014 the world’s most widely ratified human rights treaty, one specifically for children, reached the milestone of its twenty-fifth anniversary. The UN Convention on the Rights of the Child was adopted after the fall of the Berlin Wall, and in the time since then it has entered a new century, reshaping laws, policies, institutions and practices across the globe, along with fundamental conceptions of who children are, their rights and entitlements, and society’s duties and obligations to them. Yet despite its rapid entry into force worldwide, there are concerns that the Convention remains a high-level paper treaty without the traction on the ground needed to address ever-continuing violations of children’s rights. This book, based on papers from the conference ‘25 Years CRC’ held by the Department of Child Law at Leiden University, draws together a rich collection of research and insight by academics, practitioners, NGOs and other specialists to reflect on the lessons of the past 25 years, take stock of how international rights find their way into children’s lives at the local level, and explore the frontiers of children’s rights for the 25 years ahead.
