Legislation in Context

  • Categories: Law

What is a 'rational framework' for legislation? Although legislation and regulation is the result of a political process, can they also be the object of theoretical study? This book tackles this question by examining the problems that are common to most European legal systems and the approach involves applying the tools of legal theory to legislative problems ('legisprudence'). While traditional legal theory deals predominantly with the question of the application of law by a judge, legisprudence enlarges the scope of study to include the creation of law by the legislator. The essays published in the volume develop a new range of insights into the relationship between legislative problems and legal theory in a way that will interest legal scholars throughout the world. Specifically, the work will attract the attention of those involved with constitutional law, EU law, human rights law and legal theory.

The 22nd edition of the JURIX conference was held in Rotterdam on the 17th and 18th December and was hosted by the Erasmus University Rotterdam. While the conference was back to its country of origin, JURIX continues to attract a wide international audience. This year, the conference received submissions from all five continents. This clearly demonstrates the lively and growing interest for the highly interdisciplinary discipline of legal informatics. The selection of papers for this edition of JURIX covers a wide variety of topics in legal informatics, including contributions on established fields such as legal document management, argumentation, case based reasoning, dispute resolution, support for legal drafting and ontologies, to emerging areas such as regulatory compliance, normative multi-agent systems and game theory, as well as application areas, for example, fraud detection, legal tutoring systems and legal decision support systems.

This State-of-the-Art Survey constitutes the Final Publication of the COST Action IC1002 on Multilingual and Multifaceted Interactive Information Access, MUMIA. It contains outstanding research, recent developments and new directions in all related aspects of multifaceted and interactive information access with a focus on professional and enterprise search. The contributions are grouped in the following three parts: frameworks, models and theory; tools, applications and practice; and patent search. The Intellectual Property (IP) domain is used through the book as a primary case study. The book aims to bring together material which has been published in a fragmentary way in journals and conference papers into a coherent whole but also present novel, unpublished work where appropriate.

This book includes papers from the twentieth JURIX conference (first organized in 1988). Over the years JURIX has become more and more international. JURIX is originally a Dutch/Belgian initiative. Nowadays, the conference papers are in majority from non-Dutch authors, and since 2002 JURIX is held outside the Netherlands and Belgium every other year. Most accepted papers can largely be fitted into either work on argumentation or work on ontology. Argumentation has been a JURIX-topic during all past years, and the interest in ontology has revived recently with Semantic Web initiatives. The topic.

From its very beginning, legal informatics was mostly limited to the study of legal databases, but very early on, the Institute of Legal Information Theory and Techniques (ITTIG) started being involved with the specific topic of the Jurix conference, namely knowledge-based systems. This book includes programmatic papers with precise accounts of applications and prototypes. In many domains the focus has changed. For instance, research in retrieval has moved from classical Boolean systems into the management of documents in the Web. It addresses in particular standards and methods for embedding machine readable information into such documents and search methods that deal with heterogeneous inf...
