Die Arbeit ist ein weiterer Mosaikstein bei der gründlichen Aufarbeitung der durch das Allgemeine Gleichbehandlungsgesetz (AGG) geschaffenen Rechtslage. Der Verfasser untersucht die bislang weniger beleuchteten kollektiven Bezüge des AGG, die insbesondere dem Betriebsrat eine zentrale Rolle bei der Verhinderung von diskriminierendem Verhalten zuweisen. Es wird praxisnah herausgearbeitet, welche verbesserten Möglichkeiten zur Durchsetzung der Gleichbehandlung im Betrieb nach Verabschiedung des Gesetzes bestehen und inwieweit der Betriebsrat sich dieser als Instrument bedienen kann. Einen Schwerpunkt der Arbeit bildet dabei die Untersuchung von § 17 Abs. 2 AGG, dessen zahlreiche Streitfragen einer Lösung zugeführt werden. Daran schließt sich eine Untersuchung möglicher Beteiligungsrechte im Rahmen der kollektivbezogenen Normen des AGG an, bevor in einem letzten Schritt die Auswirkungen des AGG auf das Betriebsverfassungsrecht ausführlich analysiert werden.
