Global climate constitutionalism is seen as a possible legal answer to the social and political unwillingness of states to effectively tackle climate change as a global problem. The constitutionalisation of international climate law is supposed to ensure greater participation of non-state actors such as NGOs or individuals and a rollback of state sovereignty where states do not care about meeting their climate commitments. This book addresses the question of whether non-state actors such as NGOs or individuals create international climate law through so-called climate change litigation. Against the background of Peter Häberle's theory of the “open society of constitutional interpreters”, four selected cases (Urgenda v Netherlands, Leghari v Pakistan, Juliana v United States of America, Future Generations v Colombia) are used to examine how actors not formally recognized as subjects of international law (re)interpret national and international law and thereby contribute to the constitutionalisation of the international climate law regime.

Of Risks and Normative Responses

  • Categories: Law

Disaster losses in the context of natural hazards continue to rise, despite a growing understanding of disaster risks and measures to reduce them. One obstacle to enhancing private and public disaster risk reduction is the influence of the distorted risk perception of laypeople. The book argues for the necessity of public regulations and explores means to mitigate the consequences of such distorted risk perception through legal measures and adjustments to political decision-making in Council of Europe member states, while respecting the value of autonomy and democratic principles. In terms of collective decision-making, the book advocates for the implementation of deliberative fora in the de...

Class, Race, Gender, and Crime

Inequality and injustice have long been part of the structure of our society, including law, crime, and the criminal justice system. Class, Race, Gender, and Crime, sixth edition explores the continuing impact of class, race, gender, sexuality, and their intersections – and how the “justice” system can recreate those oppressions. Broken into three parts, the book opens with an overview of the criminal justice-industrial complex and introspection about the biases in criminology. Part II, “Inequality and Privilege,” contains chapters to provide a foundation for understanding class, race, gender and sexuality and intersectionality. Part III, “The Administration of Law and Criminal J...

Radcliffe-Brown

Alfred Radcliffe-Brown (1881-1995) is widely renowned as a founder of modern social anthropology. This biography challenges popular stereotypes of him as a misplaced positivist and colonial conservative. It shows Radcliffe-Brown to be a thoroughly cosmopolitan scholar, a committed fieldworker and a sharp critic of colonialism. Radcliffe-Brown engaged strategically with colonial authorities to further the interests of his discipline and invoked scientific credentials to critique central aspects of colonial rule. His struggle for intellectual autonomy and advocacy of a comparative sociological approach speaks to many contemporary concerns.
