A obra aborda a capacidade civil das pessoas com deficiência mental nos cartórios para a prática de atos existenciais. Busca responder à indagação: após a revisão da teoria das capacidades civis, promovida pelo Estatuto da Pessoa com Deficiência (Lei n.o 13.146/2015), e a afirmação de que a deficiência não afeta a plena capacidade civil das pessoas (art. 6o), quais são as hipóteses lícitas de recusa à prática do ato por elas pretendido nas serventias de notas e registros? A autora analisa os dispositivos do Código Civil alterados pelo Estatuto da Pessoa com Deficiência; as consolidações normativas das Corregedorias de Justiça dos Estados e do Distrito Federal; a jurisprudência dos tribunais superiores (Supremo Tribunal Federal e Superior Tribunal de Justiça) e as decisões judiciais e administrativas e os reflexos do Estatuto no cotidiano extrajudicial.
