The Iraqi High Tribunal (HT) has the daunting task of bringing to justice those responsible for grave human rights violations committed in Iraq under Ba'thist government. But at the same time, the court is a newly created institution in a recently-reconstituted legal system, in which lawyers and judges were isolated from developments in international criminal law and had no experience in investigating and trying complex international crimes. The capacity of the IHT to fairly and effectively prosecute international crimes has been questioned since its creation under the U.S.-led occupation.
