Cláusula de Eleição de Foro Estrangeiro
A possibilidade de afastamento da jurisdição brasileira por meio de eleição de foro estrangeiro tem sido objeto de constante discussão na doutrina e jurisprudência, eis que até o advento do novo CPC, a legislação brasileira não possuía disposição expressa sobre o assunto. O novo CPC inovou com relação à matéria, ao dispor, em seu art. 25, que não caberá à autoridade brasileira o processamento e julgamento da ação quando houver cláusula de eleição de foro exclusivo estrangeiro em contrato internacional, arguida pelo réu na contestação. Este trabalho visa, assim, endereçar os principais elementos do artigo 25 do novo CPC, oferecendo parâmetros de interpretação e apontando as inconsistências verificadas na interpretação jurisprudencial sobre a aplicabilidade da eleição de foro estrangeiro em nosso ordenamento jurídico.
Reflections on the Constitutionalisation of International Economic Law
This book collects a large number of essays written in honour of Professor Ernst-Ulrich Petersmann by his friends, colleagues and former students.
