The Third Annual Conference of the Netherlands Institute for Law and Governance took place at Wageningen University on November 29, 2011. The conference was themed "Law & Governance - Beyond the Public-Private Law Divide?". A governance approach focuses on all institutions that pursue policy goals. During the conference, the main question discussed was what this approach means for legal research and legal practice. Is the distinction between public and private law still relevant? Can the governance approach enrich methodologies of legal research? Can this approach further new types of regulation, in which the market or civil society organizations have an important input and/or which require more technical expertise? This book examines both legal practice and legal research in order to learn from the examples of problems and approaches that fit the focus of governance. (Series: Governance & Law - Vol. 9)~

With a Preface by Rein Jan Hoekstra, Chairman of the Foundation The Hague Joint Conferences on International Law The making, application and enforcement of international law are no longer confined to national States. A rapidly growing number of non-State actors also play a role. These actors are rather heterogeneous. Their role, representativeness and thus legitimacy greatly differ. However, they have in common that they challenge basic assumptions on which international law and international relations have been based. These challenges include the gradual replacement of traditional diplomatic relations by networks of national government officials interacting with one another across borders. ...

The Evolving Nature of EU External Relations Law

  • Categories: Law

This book originates from the proceedings of the 10th anniversary conference of the Centre for the Law of EU External Relations (CLEER) in which renowned experts in the field took stock of recent evolutions in the law and practice of the EU’s external relations. In particular, the book addresses the question of how the evolving legal and political framework affects the nature of EU external relations law. The contributions discuss the actions (and reactions) of the EU through external action instruments in a number of substantive areas such as migration, trade, neighbouring policies, security and defence. By shedding light on the most significant developments of the past decade this edited...
