Dignidade da Pessoa (e Direitos e Economia)
Pessoa é nome de dignidade. E dignidade é o que distingue a pessoa dos outros seres vivos. Sendo integrada por um conjunto de valores como a liberdade, a razão o amor, a procura de justiça, o reconhecimento da igualdade com os outros, etc. Sendo a pessoa em relação com os outros, conhece-se e define-se pela sua ação que deve ser integrada pelos seus valores. A dignidade da pessoa gera direitos da pessoa que visam protegê-la e aos seus valores. Quanto ao Direito, a dignidade da pessoa é fundamento do Direito e do Estado (art. 1o da CRP). A pessoa e os direitos por si gerados estruturam e orientam a ordem jurídica. Na Economia, as relações entre os agentes económicos devem ser regidas pela dignidade da pessoa, promovendo a equidade social e o respeito mútuo entre todos os participantes do mercado.
Individuals' Income Under Double Taxation Conventions
This book analyses the treatment of income of individuals under Brazilian double taxation conventions. Each article of the Brazilian tax treaties is analysed in order to identify its characteristics, field of application, limits and criteria applied in the identification of taxpayers. The OECD Model Convention is also considered, since it is mirrored in Brazilian conventions. The analysis reveals the unconstitutional nature of Articles 17 and 19 of the Brazilian treaties as they contradict the constitutional principle of isonomy.
