European public law today calls for a thick comparative exercise in light of the European legal space. This contribution deepens this concept of European public law by engaging with past projects, in particular those advanced under the specific term, European public law, or rather its Latin and French equivalents: Ius publicum europaeum and droit public de l'Europe. Indeed, the French and Latin equivalents carry a far thicker legacy and calls for engaging with a number of dubious projects, not least Carl Schmitt's, to better grasp our contemporary situation.

Analysing international law through the prism of “cynicism” makes it possible to look beyond overt disregard for international law, currently discussed in terms of a backlash or crisis. The concept allows to analyse and criticise structural features and specific uses of international law that seem detrimental to international law in a more subtle way. Unlike its ancient predecessor, cynicism nowadays refers not to a bold critique of power but to uses and abuses of international law that pursue one-sided interests tacitly disregarding the legal structure applied. From this point of view, the contributions critically reflect on the theoretical foundations of international law, in particular its relationship to power, actors such as the International Law Commission and international judges, and specific fields, including international human rights, humanitarian, criminal, tax and investment law.

The book analyses the position of the ECtHR which has been more and more confronted with criticism coming from the national sphere, including the judiciary. This culminated in constitutional court judgments declaring a particular ECtHR judgment non-executable, for reasons of constitutional law. Existing scholarship does not differentiate enough between cases of mere political unwillingness to execute an ECtHR judgment and cases where execution is blocked for legal reasons (mainly of constitutional law nature). At the same time, the discussion under EU law on national/constitutional identity limiting the reach of the former has been only loosely linked with the ECHR context. This book presents a new dogmatic concept - 'principled resistance' - to analyse such cases. Taking up examples from the national level, it strives to find out whether the legal reasoning behind 'principled resistance' shows enough commonalities in order to qualify such incidents as expression of a 'new paradigm'.

Dieser Ansatz findet Verwendung, um neues Licht auf verschiedene Aspekte der Verfassungsentwicklung zu werfen, konkret auf die Ursprünge in und aktuelle Verflechtung mit dem europäischen Rechtsraum; das System des Grundrechtsschutzes mit besonderer Beachtung der Kommunikations- und Religionsfreiheit; das System der Gerichtsbarkeit öffentlichen Rechts; und die generell-abstrakte Dimension gerichtlicher Rechtschöpfung. Dies erlaubt Rückschlüsse auf eine Theorie der rechtstatsächlichen Verfasstheit. Dabei wird die besondere Rolle von Paradigmen für den Ursprung, die Stabilisierung und das Ende von autopoietischen Systemen positiven Staatsrechts deutlich.
