En la actualidad, son numerosas las cláusulas cuya licitud está siendo cuestionada, sobre todo en el marco del préstamo hipotecario. Sin embargo, una de las que más controversia ha suscitado en los últimos años ha sido la comúnmente conocida como «cláusula suelo». La obra que el lector tiene en sus manos tiene como finalidad coadyuvar a la determinación de la naturaleza jurídica y económica de la cláusula suelo, al mismo tiempo que ofrece una configuración del control de transparencia, al ser el mecanismo de enjuiciamiento de la meritada cláusula. Asimismo, aborda la problemática originada por la devolución de las cantidades indebidamente satisfechas en virtud de dicha estipulación, una vez que ésta ha sido declarada abusiva, y los interrogantes que suscita la STJUE de 21 de diciembre de 2016 en nuestro ordenamiento jurídico, tanto en el plano sustantivo como procesal.
