Línea jurisprudencial sobre demandas por daño ambiental
La presente línea jurisprudencial tiene como objetivo visualizar un patrón de desarrollo decisional en la labor sentenciadora del Segundo Tribunal Ambiental de Santiago, sobre las demandas por daño ambiental deducidas desde el primer caso en el año 2013 hasta el año 2021. Esto se efectuará mediante la estructuración de las 25 sentencias en fichas jurisprudenciales resaltando los puntos más importantes y destacando, además, el rol predominante del juicio técnico experto, sumado a los aspectos procesales, por ejemplo, cuántas de las sentencias son alegadas mediante recurso de apelación o si las partes logran resolver el litigio y aspectos de fondo como la repetición de doctrina, jurisprudencia y principios que utiliza el tribunal al momento de decidir.
