Die Arbeit entwickelt die rechtlichen Rahmenbedingungen für eine Kohärenz des dogmatisch bisher wenig durchdrungenen Nachrichtendienstrechts. Die Dienstgesetze müssen auch im Hinblick auf den technischen Fortschritt und die globale Vernetzung in der Lage sein, die Praxis durch einen verhältnismäßigen und konsequenten Ausgleich zu gestalten. Das Werk befasst sich im verfassungsrechtlichen Spannungsfeld aus Sicherheit und Freiheit unter stetiger und bisweilen kritischer Würdigung der Rechtsprechung des Bundesverfassungsgerichts mit den Anforderungen an ein schlüssiges Regelungskonzept und entwickelt Ansätze zur widerspruchsfreien Anpassung von Eingriffsschwellen und zur Schließung systemwidriger Regelungslücken.
