The present work examines the execution of long youth penalties amongst juvenile and adolescent offenders convicted of violent and sexual crimes. To investigate the intention of the penal system, which lies in the social re-integration of prisoners to avoid further criminal behavior, different aspects like education, care, treatment, day-release and release preparation regarding young inmates were examined in detail. For this purpose, records obtained from Bundeszentralregister (Federal Central Criminal Register) as well as prison files of relevant offenders that were released from prison between 2002 and 2007 after completing a youth penalty of more than five years were evaluated. In addition, ministerial administrative provisions as well as a survey in penal institutions were used to analyze the current situation in prison.

Based on consilia and decisiones, Wouter Druwé studies the multinormative framework on loans and credit in the Golden Ages of Antwerp and Amsterdam (c. 1500-1680). He analyzes the use of a wide variety of legal financial techniques in the Low Countries, such as money lending and the taking of interest, the constitution of annuities, cession and delegation, bearer bonds, bills of exchange, partnerships, and representation in financial affairs, as well as the consequences of monetary fluctuations. Special attention is paid to how the transregional European system of learned Roman and canon law (ius commune) was applied in daily ‘learned legal practice’. Two different sanctioning systems are applicable to young adult offenders in Germany: juvenile criminal law and adult criminal law. The present study provides an overview of the various sanctions applied to these adolescents aged between 18 and 20 and of their reconvictions during an observation period. Based on data from the German Federal Central Criminal Register (Bundeszentral- und Erziehungsregister), the study covers all convictions and juvenile diversional measures in a specific reference year. This data set allows a detailed examination of the applied sanctions and measures, the proportion of juvenile and adult criminal law, and the reconviction rate differentiated by gender, age, offence and other variables. The empirical analysis also addresses regional differences in sanctioning and examines, if juvenile criminal law is “milder” and/or more effective than adult criminal law – questions that play an essential role in the debate on suitable sanctions for young adults.

Temporary releases from prison and open prisons are elementary components of a rehabilitation-oriented prison system. This statement has remained unchanged after the federalism reform, with which the legislative competence for the prison system was transferred from the federal government to the states. The reform provides an opportunity to compare the 16 new state laws with each other and to examine the legal regulations on temporary releases from prisons and open prisons from admission to the penal institution through to discharge, taking into account normative administrative practice. In doing so, this is explored whether the federal states have maintained the standard established by the Federal German Prison Act of 1976, legitimized restorative tendencies or established innovations. The present work also makes a contribution to a constitutionally determined understanding of temporary releases from prison and open prisons.
