Rethinking the Relationship Between International, EU and National Law
The interdisciplinary embedding and novel conceptual approach offered in the book to address the relationship between legal orders offers a significant and original contribution to the literature. The first part of the book provides a critical account of dominant approaches to explain this relationship where theories of Kelsenian monism, dualism, legal pluralism and constitutionalism are criticized. In the second part, Kirchmair engages with an innovative idea by applying insights from social contract theory to the relationship between international, EU and Member State law and establishes his theoretical approach: Consent-Based Monism. The book focuses on the most important structural characteristics of the external relations law of the EU as well as the primacy of EU law in lieu of national constitutional identity which is demonstrated in part three.

Paradigmen im internationalen Recht
Die Neuerscheinung "Paradigmen im internationalen Recht" und "Implikationen der Weltfinanzkrise für das internationale Recht" waren die Oberthemen der 32. Tagung der Deutschen Gesellschaft für Völkerrecht, die vom 30. März bis 2. April in Köln stattgefunden hat. Unter dem Oberthema "Paradigmen im internationalen Recht" werden "Denkschulen" und "Rollenverständnisse von Denkern und Praktikern" (jeweils im Völkerrecht und im Internationalen Privatrecht) sowie "Paradigmen in der internationalen Praxis" verhandelt. Das Oberthema "Implikationen der Weltfinanzkrise" wird vielschichtig aus materiell-rechtlicher, institutionell-prozeduraler, rechtspolitischer und sowohl öffentlich-rechtlich wie privatrechtlicher Sicht erörtert. Dieser Band vereinigt die Referate und Diskussionsbeiträge der versammelten deutschsprachigen Vertreterinnen und Vertreter des Völkerrechts und des Internationalen Privatrechts.
Technik - Recht - Raum
Die Ubiquitat des Kommunikationsraums "Cyberspace" erschwert bis heute dessen raumordnungsrechtliche Einordnung und einheitliche Regulierung. Das Recht tut sich schwer mit der Normierung des technisch konstituierten "virtuellen Raums". Aber warum? Am Beispiel des Cyberspace analysiert Camilla S. Haake Dynamiken der Entwicklung von Recht und Technik und konzentriert sich dabei v.a. auf die grenzuberschreitende Dimension und das Verhaltnis von Volkerrecht und Technik. Die Autorin zeigt Ansatze einer volkerrechtlichen Regulierung von Aktivitaten im Cyberspace de lege lata und de lege ferenda auf und identifiziert Veranderungen, denen die bekannten volkerrechtlichen Werkzeuge und Prozesse der Normsetzung und -durchsetzung aufgrund des Einflusses des technischen Wandels unterworfen sind. Umgekehrt analysiert sie jedoch ebenso die innovationshemmende bzw. -fordernde Wirkung unterschiedlicher Regelungsmechanismen.
International Legal Responsibility of International Organizations in the ILC Draft Articles and Beyond
The phenomenon of proliferation of international organizations has urged focus on the responsibility of international organizations under international law as the effect of their activities is witnessed everywhere in our daily life. The main purpose of the present book is to examine and review some specific aspects relevant to the question of international legal responsibility of international organizations, mainly, with a view to assessing the International Law Commission’s work on the codification of the international legal rules applicable on international organizations in this area. At the same time, the intention is to address the major challenge to the codification of general rules for international organizations, namely, their wide-varying nature and their differences from each other. Furthermore, the perspective has been enlarged by elaborating on the broader concept of accountability of international organizations.
