The process of collective bargaining between unions and employers' associations in Germany is under threat. This is due to political discussions challenging it as just another trust and lack of union strength due to high unemployment. One challenge is the concept of pact for work (Buuml;ndnis fuuml;r Arbeit). This means the works council and not the union enters into agreements with the employer for working conditions less favorable to workers in exchange for a job guarantee. Under the present jurisprudence, this is illegal under the collective bargaining act (Tarifvertragsgesetz) and the constitution. However, legislative proposals to change that were made in the last legislative period and a justice of the constitutional court indicated that things on the constitutional level may be about to change thereby following a way of thinking promoted by organizations financed by an employers' association. Even Labour Courts as an institution are under discussion to promote freedom of contract, thereby endangering the protective function of collective bargaining.
