Mirroring the expansion of wealth in the Middle East and Asia and a surge in Islamic self-identity, Islamic banking practices have either become the law of the land or coexist and compete with Western practices in at least six countries. A growing number of institutions and mutual funds (akin to Western ''socially responsible'' funds) have established Islamic investment and other practices to cater to this burgeoning market. Because of its prevalence, practitioners in every banking-related area must familiarize themselves with current Islamic finance practices in order to do business with Muslim clients and to engage in cross-border financing. Injunctions from the "Qur'an and the sayings of Prophet Muhammed have generated a web of interrelated norms which prohibit Islamic financiers from engaging in transactions that involve interest "(riba) and speculation "(gharar). Since banking and financial industries in countries observing Islamic law and the Shari'a are growing fast, it is essential for the West to obtain a better understanding of the interaction between Islamic law and finance. As all financial business is bound by the Shari'a, western lawyers and economists must consider the extent to which flexibility exists in the western system whereby the two systems, western and Islamic, can be brought closer together. The Islamic Law on Land Tax and Rent
This book, first published in 1988, argues that a close inspection of the development of Hanafite law in the Mamluk and Ottoman periods reveals changes in legal doctrine which were not restricted to civil transactions but also concerned the public law. It focuses in particular on the interrelated areas of property, rent and taxation of arable lands, arguing that changes in the relationship between tax and rent led to a redefinition of the concept of landed property, a concept at the very heart of the Islamic legal system. This title will be of particular interest to students of Islamic history.
Al-Nihayah: A Concise Description of Islamic Law and Legal Opinions (al-Nihayah fi Mujarrad al-Fiqh wa al-Fatawa)
Islam is an all inclusive way of life which covers the intellect and the real, the theoretical and the practical. The major part of the Islamic code of practice and behavior is formalised in the discipline of Islamic law which established itself as a discipline before other Islamic disciplines. The early Muslim jurisconsultants are to be credited as the pioneers of the development of the Islamic legal system. Shaikh Mohammad ibn Hasan ibn 'Ali Abu Ja'far al-Tusi (385-460 AH/995-1067 AD), who was given the honorary title of Shaikh al-Ta'ifat al-Imamiyyah (The Head of the Shi'a Islamic School) was at the orefront of these pioneers. His book Al-Nihayah fi Mojarrad al-Fiqh wa al-Fatawa (A Concise Description of Islamic Law and Legal Opinions) has been recognised as one of the major early sources, references and textbooks in the field of Islamic Law in general and of Shi'a Islamic law in particular. This book has been translated, edited and introduced by Professor A. Ezzati, and published by ICAS Press as the present volume.
