A presente obra busca fundamentalmente entender, de um ponto de vista da Teoria da Constituição, como nossa sociedade chegou até o ponto deplorável em que nos encontramos. O autor tenta reconstruir um arcabouço teórico constitucional capaz de dar conta das peculiaridades e concretudes do desenvolvimento social e histórico brasileiro, diante do que enxerga como um déficit sociológico na teoria constitucional brasileira e internacional, conforme observou o prefaciador, Daniel Capecchi, que acrescenta: "Em outras palavras, é o exercício de pensar o constitucionalismo brasileiro em sua realidade social localizada, rejeitando uma perspectiva dominante que enxerga o fenômeno constitucional de forma puramente idealizada, sem qualquer esteio no mundo concreto.
