Brazil's Living Museum
Brazil's northeastern state of Bahia has built its economy around attracting international tourists to what is billed as the locus of Afro-Brazilian culture and the epicenter of Brazilian racial harmony. Yet this inclusive ideal has a complicated past. Chronicling the discourse among intellectuals and state officials during the period from the abolition of slavery in 1888 to the start of Brazil's military regime in 1964, Anadelia Romo uncovers how the state's nonwhite majority moved from being a source of embarrassment to being a critical component of Bahia's identity. Romo examines ideas of race in key cultural and public arenas through a close analysis of medical science, the arts, education, and the social sciences. As she argues, although Bahian racial thought came to embrace elements of Afro-Brazilian culture, the presentation of Bahia as a "living museum" threatened by social change portrayed Afro-Bahian culture and modernity as necessarily at odds. Romo's finely tuned account complicates our understanding of Brazilian racial ideology and enriches our knowledge of the constructions of race across Latin America and the larger African diaspora.

O objetivo do presente trabalho é analisar a natureza jurídica, características, efeitos e exeqüibilidade da opção de compra. O interesse pela matéria foi despertado em razão de dois motivos especiais: em primeiro lugar, pela verificação de inexistência de uma posição dominante – aliás da existência de uma grande diversidade de opiniões – acerca da natureza jurídica da opção de compra; e em segundo lugar pela constatação, dada a ausência de uma regulamentação legal específica do instituto no Brasil, de inúmeras limitações e deficiências para a sua utilização adequada, especialmente na esfera do Direito Imobiliário.
Tutela Específica das Obrigações Contratuais
No direito brasileiro, a resposta preferencial para o descumprimento do contrato é a concessão da tutela específica da obrigação inadimplida. Assim, como regra, o credor pode exigir a imposição de medidas judiciais voltadas à obtenção do resultado que foi prometido. Mas o que acontece nos casos em que os benefícios buscados pelo credor se mostram desproporcionais aos custos impostos ao devedor? A tutela específica deve ser perseguida a todo e qualquer preço enquanto permanecer possível e desejada pelo contratante prejudicado? Diante de situações desproporcionais, vários países têm admitido a substituição da tutela específica por outros meios de proteção do crédito. Esse tema-problema, no entanto, continua pouco debatido no Brasil. A partir de um estudo comparatista interdisciplinar, o presente trabalho apresenta algumas propostas de solução adequadas ao ordenamento jurídico nacional.
